Course Description

This course gives a comprehensive review of the law of evidence as it relates to the admissibility of character, other crimes, wrongs, and bad acts. This course begins with a discussion of character generally and the exceptions to admissibility of character evidence including: character of the accused, character of the victim, and character of witnesses for truthfulness/untruthfulness. This course includes a discussion of the rape shield statute (Art. 412), victim's attire in sexual assault cases (412.2), the admissibility of character evidence of the accused in sexual assault cases (Art. 412.2), and character of the victim in sexual or human trafficking cases. There is also a discussion of habit/routine practice (Art. 406), as well as credibility provisions, including convictions (Arts. 609/609.1) and other types of credibility evidence (Arts. 408, 413). The lectures also include updates from the 2016 Regular Legislative Session. This course ends with an overview of how these concepts relate to each other in a trial from a practical approach- what may be offered in case-in-chief, only in rebuttal, etc. This course presents an excellent opportunity to learn or freshen up on the law of character and other crimes in one place so that the concepts make sense together.
